  • Enforce a wasted costs order

    Hi everyone,

    Can anyone help me with my problem please.

    On Feb 14th 2014, the Crown Court ordered the CPS to pay me nearly £2000 in wasted costs but they will not pay me. Anyone know how I can enforce the order?

      Hi ploddertom, thanks for the reply. On the day they did not have a representative at court as they couldn't find anyone at short notice and they feel that the judge should have adjourned the hearing. The judge wouldn't adjourn and went ahead. The CPS have said that they don't feel they should have to pay it because of this. Neither myself or the court have had any written contact from them.

        Do you have an Order or similar from the Court telling them they have to pay? Are you able to go back to the Judge/Court and advise them of what the CPS are saying/doing? I would have thought that is the CPS's problem if they couldn't be bothered to attend, after all I'm sure they would have had plenty of notice.

        Have to be honest and say I don't know how the criminal system works as am more used to civil claims. If it is at all similar then for the amount owing I would employ a HCEO. There would be nothing to lose by talking to one, a good start could be The Sheriff's Office.

          I have an order telling them to pay me FORTHWITH. I've spoken to the court several times but they just say its my problem as they've issued the order and thats that as far as they are concerned. I am going to write to the judge though. I've thought about HCEO but the website says County Court and High Court orders, do they enforce Crown Court orders as well?

            Ring them and ask. My experience of them is that they won't take anything on they can't do.
