    Just saying Hi, and letting you all know that in this less than 24 hours I got so much help here that it easily surpasses any other help or advice ever. I'm beyond happy that I found Legal Beagles!

        Is there a thread that I didn't find that is about taking private debts to Small Claims court?

        I had a case last year claiming back moneys from someone (not a company tho the difference isn't that much on Small Claims) and since you all have been so amazing, I thought if anyone needs help/advice that area I could help :tinysmile_kiss_t4:
        I had to study my way through the claims and forms and such, and did it all bby myself and won tho she defended and counterclaimed, plus had the defendant's appeal set aside. She paid it at the end!

          Although not directly related to the court process, this article refers to laying the ground for a claim for personal debt, especially where the is no written agreement, it relates to showing the loan wasn't a gift.: http://www.thisismoney.co.uk/money/e...-000-loan.html

              I sued someone cos she disappeared with my £2100 and refused to react to the demands. She was a friend of mine and the money was due to me helping her when she had no earnings etc, upon agreement she pays back after, but once she had the money she just decided/told me "it all should've been free" and I am a crappy friend for counting on her paying it back... so the friendship was done. There was no written agreement since I didn't make a friend sign one - and I was abroad when she decided to disappear (since she "lodged" in my flat otherwise it would've been hard to disappear.) I only had a skype chat when I made her agree in her own words. But then she went on telling to others, in skype chats that she will pay me.... insert facepalm smiley here.
              She owed me 3300 and paid only £1200 and then played the "I have no money, my family is in need" on earnings of £51000 per annum plus benefits and 25% per annum extra.

              She defended (lied on the defence form) and counterclaimed (again, lied then signed the affidavit...) and then she "missed" the deadlines to send back AQ, and then to submit the evidence. When she found out who my witnesses are she tried to contact the key witness but the witness ignored her. Then she went on trying to sell to the judge that 1) she didn't receive on her work address the correspondence from the court tho she works for a corporate and they collect post, but according to her, once the post dep signs for it they don't give it to her for weeks! and 2) she didn't give her home address but work, because I harassed her before (the required two demands letters before claim filing on MCOL) and I'd be stalking threatening following her home (note I live in a different city.) and by the way I threatened her and her family (whom I don't even know) and I used violence against her and she feared for her life. According to her she feared to go to the police because I was so dangerous. (Please don't believe I am, this is all humbuk.)

              She even appealed against judgement though I advised her (when she tried to sweettalk me out of making her pay the CCJ, as if it worked like that) if she pays off within 30 days the CCJ can be waived from her credit records AND I offered her a payment plan within the 30 days. So she said these things about me in front of the judge and myself. Hardest 10 minutes of my life But of course the judge upheld the CCJ and denied any further rights of appeal to her.
