  • HELP DVLA wanting to fine me twice for same offense

    Please help.
On the 1/11/12 i was pulled over by a white transit van into a layby, it turned out to be a camera vehicle for untaxed vehicles.
Right first of all, i was driving an untaxed vehicle due to my computer crashing and not being able to tax vehicle online, we were also late as we were going to a wedding, so i took all the documents with me so i could do it online at the hotel, when i was pulled over i explained all this and showed all my documents, the bloke did not want to be very helpful to say the least, he clamped the car and i then had to pay £260.00 to have it released, ok i was annoyed but, what else could i do.
Anyway got to hotel used hotel computer to tax online, end of story i thought.
I have now recieved a requisition to attend court for using a motor vehicle untaxed on the road, i was told by the man who clamped me that nothing else would happen, and now nearly six months later i have recieved this requisition. what the hell do i do now..

When you were clamped the vehicle was indeed untaxed this is an offence and rightly but you wont agree is why you are summonsed to court you can try the computer dont work offence may work ,the moral here is as the reat of us tax our vehicles and pay through the nose why should otheres fet away with it,sorry its not what you want to read but that my view shared by many others

That will be no defence. You could have gone to a Post Office.

Who actually pulled you over, the police or Capita employees masquerading as DVLA employees?
Life is a journey on which we all travel, sometimes together, but never alone.

You don't have a defence so go to court and plead guilty and hope the magistrate/judge is in a good mood I suppose

Thanks for all your advise, it was capita who pulled me over not the police, i'm not trying to pull the wool over the law, but was told after being clamped that that was the end of it, vehicle was untaxed for about 18 days,

Crapita don't really need to tell lies - they're so inept it's rarely necessary!

Shock!! Horror!! Capita lied.........and now you have to go to court, plead guilty and pay the price for not abiding by the law and having your car untaxed for nearly 3 weeks,,which as you probably know invalidated your insurance too..I'm horrified that the clampers allowed you to continue on your journey in an untaxed car but heyho,,they had their pound of flesh ,they were no longer bothered what you did.

If you hadn't taxed the van, your were probably also driving without insurance, which initself is bad enough......... but........... why the hell were you going to a wedding in a white transit van for gods sakes ?

Let me get this clear. Your computer crashed for eighteen days, it was impossible to find another computer of any sort for eighteen days, and the post offices in your area were all closed for eighteen days. Presumably your landline, your mobile phone and all telephones in the area were inoperative as well? And since it was overdue by eighteen days, all these instruments of renewal were equally inoperative in the 25 or so days before it was due to run out, during which period you could have renewed it?

Perhaps the bride's father could not afford a limousine?
