my payments are up to date, i have never missed or been late on a single payment, it annoys me because some months its been really tough to find the money but my mortgage payments is the one always at the top of our list,also its on direct debit from my bank, positive never ever missed one payment, the mortgage company is redstone mortgages, we borrowed to buy the buisness here and that was on our original application for the remortgage

will do thankyou, i did email their solicitor back this morning requesting that they allowed me more time than sixty days, i have asked for twelve months on the grounds that the work here is seasonal and it is the start of the season in two weeks, t hat i will try to sell on our buisness here which would leave us in aposition to pay back the loan in full. l have a friend here who is going to go through all of my correspondence with them and put it in order for me to send on to a uk solicitor to see what he can make of it

These are the things you need to check out with a lawyer when you show him your loan agreement. A SAR will take 40 days and they've only given you 60 days before they intend to seize your property so dig out whatever paperwork you've got and show it to a solicitor specializing in property issues quickly. This isn't one for the CAB!

i havent got a solicitor yet, it is theirs that is contacting me, i can only contact the direct by telephone ( which i have to use a uk mobile as their number does not accept calls from overseas land lines) or by post which can take a week to get there, they have no email address for the department, the only email they have is for making enquiries for new products. i tried emailing on that before and you get no reply!

i will have to go through my emails, it was before christmas, also what i find confusing is that they have said on the letter i received that they are unable to accept our request to change to a buy to let mortgage, i did not request this anyway, i gave them all the relevant details when they found out i was renting the house out, i told them in the letter that this is our home, we do intend to live in it and have rented the house out because of curcumstances with our buisness, we were going to have it managed for us but with the economic down turn we had to manage it ourselves, which was fine until our last daughter moved out, we then rented the house out so it wasn't left empty for six months at a time, they have my full address here and my parents address in the uk as contact addresses, i never requested a different product

You definitely need to get a solicitor on your side as soon as possible. The people you are involved with are only after your equity in the property and are using the letting clause as an excuse to repossess so they can rob you blind. They will repossess and sell your property to cover the amount owed by you and will add charges on top to swallow up what's left leaving you with nothing. You have come to the right place for advice but you need to follow the advice and get a solicitor to help you fend off the vultures.
