    Hello all at legalbeagles and fellow forum users.On 4/02/13 i sent a 'prove it' letter (recorded del) to Scotcall DCA after two doorstep visits and a number of 'threat letters' from various DCA's.Last week i received letter offering 'amazing settlement offer' of a reduced amount to settle 'debt'.No acknowledgement or comment on my 'prove it' letter was given.The 'debt' refers to an overdraft facility on a joint a/c with my ex wife some 7 years ago which the bank acknowledged at the time that the debits were made by my ex using her card.Can you please advise my next steps please?Many thanks,

    Hi and welcome

    If you haven't made any payments or acknowledged the debt in writing for at least 6 years (5 in Scotland), then the alleged debt would be Statute Barred. If so, you don't have to pay a reduced amount, you don't have to pay anything at all. When a debt is SBd, all the debtor has to do is inform the DCA of that fact and they should cease all collection activity immediately.

        DCAs like Crapbot buy debts in bulk without any history or details, it has to be pointed out to them that they've bought a lemon!
