    The levy - as is quite usual - seems intended more to give her an excuse to charge fees than to pay anything of the debt.

      I signed both form 7 on 1st visit, on 2nd had 2 just sign a form stating what arrears were but with the 146 plus 1file on it if I miss a payment, iv now missed 2 but hav had no letters or cards put thru door??? neet.

        I still do not understand what was meant by "1 file".

        Never mind.

        Please list the items on each form 7, as it may be quite possible she had listed items that could not lawfully be seized.

          New Forest District Council and Ross & Roberts have an unholy alliance. There was a case on Consumer Action Group's website, during 2012, involving NFDC and R & R. The sort of behaviour the bailiff engaged in, on the face of it, sounds totally unlawful and, possibly, illegal, also. In the case last year, the bailiff had their certificate revoked without a court hearing, such was the serious nature of their actions towards an alleged debtor. What was the name of the bailiff or bailiffs involved in your case, please?

          NFDC has sold their souls to the devil named Capita, which just happens to own Ross & Roberts. If you are a single parent and on benefits, you are classed as vulnerable under national guidelines both NFDC and R & R have signed to abide by.

            no she hasn't listed exactly the same on each but both have
            car
            table
            6chairs
            2seater sofa leather
            3seater sofa leather
            sideboard
            tv
            stereo (4pieces)
            speakers
            dvd pplayer
            pc and mmonitor
            and on the 348 file 1x glass (unlegible) 6x (unlegible) and 5x (unlegible) these can only b my glass nik naks on my sideboard and table!!

              1file is the 575 debt the other file is the 347 debt,neet.

                I agree with the vulnerable, I explained I had 2 go on anti depressants because I was sent 2 prison for 1month in oct 2011 for non payment of tv licence fines, lady from council said I should pay my bills then!!! tbh I'm thinkin maybe it would just b easier 2 go back 2 prison for this, atleast it will b ova, neet.

                    OK. Well, one or other of those levies is invalid simply because the same items appear on each.

                    The table and chairs should not have been listed on either form 7, as such items are exempt from seizure. The sofas may also be exempt.

                    Listing exempt items can make the whole levy bad.

                      You are vulnerable. Full stop. If NFDC and R & R will not take this seriously, the Local Government Ombudsman is likely to give them a hammering as was given to Blaby Council. Get on to your local Law Centre or Community Legal Service first thing tomorrow morning. From what I have read, the bailiff's actions are totally unlawful. This bailiff is heading the same way as the bailiff last year - Jobseekers Allowance. Could you let us know the name of the bailiff involved, please?

                              Get onto your local law centre tomorrow, as Bluebottle and I have suggested.

                              Listing exempt items can make the whole seizure invalid but, then, if the bailiff does not have a current and valid certificate - and I couldn't see her listed - the levies are automatically invalid and any attempt to claim fees would be illegal.

                                The bailiff's actions alone may mean the levy is invalid. If she has tendered false particulars, that is a sign she knows she has acted outside the law. That is a common tactic of bent bailiffs.
