hi 2 all, I would like advise on a Ross and Roberts matter,

  • hi 2 all, I would like advise on a Ross and Roberts matter,

    I hav let them in on 2 occasions, had I known about this site I would hav refused entry! anyway, I have not paid the last 2months and on last visit was told they will b removing car, tv,table n chairs, sideboard!!! I have signed paperwork with regards 2 this as I was told if I didn't they would remove them there n then, think iv only got 3-4 payments left on the council tax arrears I incured.can they take my stuff? can I tell them 2 go away? will they call police if I do this? can police make me let them take my stuff? what happens if kids open door? thanx 4 reading this hope sum1 has answers, neet.

    You really need proper legal advice and help from your local law centre - link

    The levy is, of course, improper or invalid, as distress may not be levied on certain goods such as a table and chairs. If the levy is bad, then the bailiff does not have any right to force entry, but you'd probably need a lawyer's letter to stop the bailiff and/or convince the plods that the bailiff is wrong.

      Did they have a valid levy when they called on the previous occasion? Also, they cannot attend to levy and remove on the same visit as they must give you an opportunity to pay. It also sounds like they obtained a levy by coercion which may well mean that the levy and any seizure is invalid. Speak to someone at your local Law Centre or Community Law Service.

              When did you sign the WPO? Was it on any of the previous occasions or when they made threats? It sounds like they have engineered a default in order to bump up their fees. Obtaining a levy by coercion is a no-no. When you let them in on previous occasions did they -

              a. put their foot in the door as soon as you opened the door to prevent you closing the door;
              b. push past you;
              c. resort to lies or threats in order to gain entry?

              If any of the above, both they and the local authority are in the poo. Which local authority is involved, please?

                ok, on 1st visit she(bailiff) said I had 2 agree 2 payin 77 a month even tho I stated I was now on income support this is an amount that is to high 4 me, she stated I had no choice that was what I had 2 pay, my original debt was 575.45 and another for 348.89, with bailiff coasts of 97.50 and 47.00. I missed a payment in aug and she was at my door in 5days, I was out n called her, she said I had 2 get 230 for her wen she called the next day, 146 costs plus the 77 missed, wen she called she sed I HAD 2 sign the walkin poss or she was takin property, I signed this and on it states that next missed payment means 146 costs plus 1file, I am with new forest district council, I had foned them in aug 2 see if I could pay them rather than r&r and they refused me, hope that makes my situation a littl clearer, neet

                  she threatened 2 take my car and goods there n then on 1st and 2nd visit, on 2nd visit it was either pay fee and monthly amount or she's takin stuff, whilst she was here she stated that she will call some colleges that will b here 2 take stuff immediately had I not had the money, I had called her saying I need cuppl more days 2 get all the cash as I was 30 short, she had no sympathy just said she will bring a bigger van, n asked if I could borro it from a neighbour??? neet.

                    Her deplorable tactics are, unfortunately, entirely typical of such certificated bullies.

                    The levy fees are given by paragraph 2(1) of the attached file.

                    For the debt of £575.45, the lawful fee would be £(24.50 + 16 + (75.45 x 2.5%)) = £42.39
                    For the debt of £348.89, the lawful fee would be £(24.50 + (248.89 x 4%)) = £34.46

                    I have not the least idea of how the ba:censored:rd bailiff came up with her "fees".

                        thanx cleverclogs, hope u don't mind me askin but what would u suggest I do, I'm already tellin kids do not answer door and never leave windows open and most importantly ALWAYS keep doors locked, iv explained 2 older kids but hav 1 under 5 that doesn't understand why the door must not b opened, I hate living like this and accept I owe this money but feel that iv been/being held 2 ransom,neet
