Last December (2012) I recieved a CCJ from BT regarding a company credit card I had while I worked there. I have issue with this and don't think BT has adequately shown that I owe all the moneys asked for in the CCJ.
Is there a way at this stage to have the CCJ removed while we sort out fairly what I owe?
Originally BT called me in June 2012 and said I owed £486 in ref to said Credit card, I said that as the card was taken off me at my doorstep by an ex collegue (I was asked to sign nothing, no reciept was given) I asked the lady at BT for a statement as I would like to tally the figure and dates money was spent with my own paperwork to make sure I was happy, she declined to send me a statement.
I heard nothing more until late December when a neighbour delivered a letter that had been posted in the wrong flat containing a CCJ (in default) for the amount BT had not adequately shown I owed + costs!
Apparently the paperwork that gives me the chance to put my side over had been sent late October by it wasn't sent recorded and it never arrived at my flat ( I live in a block and mail regularly gets lost or put through other doors).
In Febuary a Bailiff from Marstons turned up at my door, I sent him on his way then phoned up BT Legal (as named on my CCJ) and spoke to a woman there, I said I wasn't happy as they hadn't shown me a statement as I'd asked for back in June over the phone proving that I owed the amount asked for, the lady at BT denied that I'd ever asked for a statement, I asked if I could pay the whole amount to her then and there but she declined.
I called her later the same day (after getting legal advise) it was during this call that she said that she did remember me asking for a statement and that she had sent one (she hadn't, she told me in June to call Steria, the Credit Card company and ask them, all she wanted was the money!).
I'm sorry, this post seems to be going on some!
Basically, I am happy to pay all that I owe, but think BT has acted very badly and I don't want or think I should have this CCJ against me, is there anything I can do?
