    Hi

    I am in dispute with a former landlord on a commercial property I let. I sub letted the property on to a new tenant who fell behind with the rent. The lanlords solicitor have now issued proceedings against me. They havent even tried to recover the funds from the tenant as they see me as a better bet. I have noticed that the landlords solicitors have done a credit search on my. is this permissable without my permission? any help much appreciated. Thanks.

    You have the 'head lease'. Their relationship is with you, not the other person.

    It is possible to write into the letting agreements terms that mean that the person to whom you sublet is effectively renting from the landlord. If they default, they are the ones who are pursued. I assume that you did not do this.

    Yes, innumerable such searches are conducted every day.

      Unfortunately I agree with previous writer
      1) If your subletting without permission your in breach of contract
      2) The contract is between you and the landlord not anyone else at al they cant pursue your tenant as they have no contract with him
