Notice of Distress Warrant

I now live with friends who have been very good to me - my home in UK was repossessed in April.

I am trying to sort things out but I owe thousands of pounds and most of them are under control paying them back on a monthly basis.

However I have been served a Notice of Distress Warrant and they are demanding £55 per week which I simply cannot pay. They say they will send the bailiffs to the house of my friends and take goods - but it is not my stuff. I own nothing more than my clothes.

How can I appeal against the £55 per week. The total costs I need to pay are £660 - Very stupidly for not paying a train ticket surcharge of £25 - I just ignored the demands - I have been stupid.

Please any help will be gratefully received

Whilst we are waiting for someone more experienced to come along and help you please have a read of this thread which should give you some general guidance http://www.legalbeagles.info/forums/...The-First-Time also we have a Bailiff section http://www.legalbeagles.info/forums/...Bailiff-Issues if you post in this section you will get a lot of help and also there are a load of useful stickies on Bailiffs like the one I have copied and pasted for you.

Also, Bailiffs cannot gain entry to your friends place of residence unless you or they invite them which you do not have to allow them to come in also they cannot take goods or chattels belong to another person if they did gain admittance.

Hi Alydd and welcome to Legal Beagles! You've come to the right place for help, and please don't worry.

The first thing I need to explain is that a huge sum is being demanded because you've ignored everything so far. That does not mean the fine will be any different, but it does mean you missed the chance first time round of providing an Income and Expenditure breakdown to show your financial circumstances to the court. They would then have ordered a more reasonable repayment plan.

What we need to do is try and get you back to that position again.

With a Magistrates Court there is a very rigid procedure which has to be followed. It is outlined here under the heading 'Procedure':

Have a read, it should hopefully be helpful. With regards to the procedure, did you receive the 'Further Steps' notice?

Also read the section above which tells you what to do if you cannot afford the repayments demanded.
