        Hi, just a quick note to express my disgust at how you were treated. I sincerely hope you get a result.

        I was just going to point out that your existing buildings insurance, or possibly contents cover if seperate may have Legal Expenses Insurance cover built in which will cover the cost of funding a legal claim against, say the freeholder or the solicitor (or both even). I've just done this for an employment tribunal for unfair dismissal, and it's been an absolute godsend.

        It's certainly worth a phone call in any case

          Thank you so much Crowie! That's something that I had not thought of or have been advised of. I will most certainly check it out.

          The Freeholder is a complete scoundrel. He is totally aware of my situation and shows absolutely no care or regard for the grief that he is causing by withholding my money. I had another angry call from the builder yesterday and the stress of the whole situation is definitely taking its toll. I am seeking advice from every avenue and it looks as though the small claims court may be my only option. Although I am gathering the documents advised by Nickolai. Small claims court may take time though and is not 100% guaranteed as (although I pay the extortionately expensive policy) the policy is actually in HIS name!
          It appears as though he has had previous experience of using this detail to steal money from freeholders. In any case he has not answered a single one of my emails or phone calls!

            You really need to check what your lease says about buildings insurance as soon as you can. Post it here (not the whole lease just the bit about insurance) and I'll check it for you if you like.
            You may find that you're jointly insured with the freeholder, which would give you some advantage. Just thinking aloud, who instructed the builder? Was it you or someone else?
            On a practical note, if the builder loses patience and starts a claim against you in the small claims court, it seems to me you have a complete defence, and can claim a full indemnity from the freeholder. Why not suggest to the builder that he claims from the freeholder rather than you? After all, it's not you who's had the money.

              Forgot to mention that the point about legal expenses cover is worth looking into. Check ALL your insurances, as this sort of cover is often added on to different types of policy. Some credit cards provide this cover too.
