    Hi
    my wife unlocks and locks a small local play area for the Parish council
    She is paid a retainer of £60 per month
    Although it only takes a few minutes each day, she is on duty 7 days a week including bank holidays with only a few days allowed for holidays
    Is this allowed or should she be given at least one day free from duty a week
    She has been doing this for about 20 years

    the working time directive will not apply in this case due to the actual working hours,
    (well you cant even call them hours) working minutes averaged out over a 17 week period

    the thing is. you mention a retainer by the parish council, that is not a contract of employment as such, it would come under voluntary work with expenses

    if she has a contract of employment from the local authority/borough/district council then their may be a case to argue, but i doubt it as its a retainer

      it might not even be a retainer it could be classed as voluntarty work and make an ex gratia payment . these are actually counted as gifts
