          Re: music licence

in your situation i would send ppl a letter before action stating their demands are unlawful as previously informed

demand to know under what authority under the data protection act 1998 they have sent your personal data to an outside collections agency MIL collections. Ask ppl what contract you have with them to enable them to process your data.

tell them what civil tort you have committed in that a radio in a lone office with no public access is contravening the performing rights society and payment can be demanded

tell them their response will be escalated to the information commissionairs office and that their agents MIL collections are culpable as well

you consider this demand for payment an abuse of the Consumer Protection from Unfair Trading Regulations 2008 and will be reported to the Office of Fair Trading

send to ppl and mil collections by recorded delivery

          JUST LOOKING INTO THIS

IF YOU ARE A BUSINESS WITH A RADIO IN THE OFFICE AND NO ACCESS TO THE PUBLIC, THEN THEY CAN GO AND WHISTLE

Can I email them with your reply as they have addressed everything to the director of the company no longer trading and not sure I want to send current letterhead?

I'd be tempted to return their post as "company not recognised at this address" or similar

                    Re: music licence

why is the OP even dealing with this if a company no longer exists except for debts guaranteed by any individuals nothing is owed to anyone unless there is an admistrator involved surely the only course of action is to ignore everthing unless a summons to county court arrives then defend this it can only be thrown out and the Op claims and no doubt will get expenses please someone correct me if im wrong

                        Re: music licence

Hi all, received this email this morning from PPL.

"Thank you for your recent email regarding this PPL account. This is to confirm that you will not require a PPL licence as a lone worker.
PPL are happy to accept your email as declaration that the use of recorded music - whether you are playing music via a radio station, CDs, a TV or any other format, is only used by yourself not audible to staff or customers.

Whilst we respect that you may not have any music in use publicly, it is PPL’s duty to inform you that a Business Relationship Executive may visit the premises - as well as those in your local area, to advise on music licensing requirements and ensure you are correctly licensed.

In light of this, I can confirm that accounthas been closed, and the invoices have been cancelled.

Our third party collection agents MIL have also been made aware that this account has been closed, and will no longer be in contact with your business."

RESULT!! However, a Business Relationship Executive (a what??) may visit just to check you are not telling porkies

how dare you challenge their speculative invoice

good result and well done for standing up to them

i would be demanding though on what authority they transfered your details to a collection agency without just cause and that they are in breach of the DPA 1998

                          but thats me

Hi Miilitant, think it was your tips for writing the email of complaint is what did it, thanks x Had to Google "civil tort" didn't have a clue what it meant, only got a vague idea now! Think I'll leave it at that as I'm still having problems with Jacobs Bailiffs on another issue.

Wish I could win the lottery, not all of it, just enough to sleep at night.
