  • Marston Baillif Advice Needed Please

    Help or advice needed please.

    I apparantly received a parking fine in May 2011, there was no ticket on my car and I don't recall receiveing any notification for this fine. I moved house and sold the car in July 2011. I then get a call from the new resident of my old house saying a bailiff has been round and left a notification, not in any envelope, saying I owe Marstons/Swindon Magistates £330.00!!!!

    I spoke to the Bailiff and he said there is NO way round this, a letter was apparantly sent to my old address and it isnt 'his' fault that it wasnt forwarded to me......

    He also said if I had paid within the 7 days as the letter said, the fine would of been £80, so thats an extra £250 for ONE visit.

    Due I have ANY chance of just paying the original fine AND is it morally right or legal to charge £250 for one bailiff visit??, can they charge whatever they want.

    Should I go to the Magistates in my old town to plead my innocence and try and pay the original fine or would I be wasting a 2 hour drive and my time.

    Any advise would be great as I have till Monday to cough up???

      I had a read and I will apply for the Out Of Time Notice.

      When it comes to the charges the Bailiff has applied, is this correct, can they charge £250 for one visit even if I don't live there or wasnt in?

        The short answer is no, they cannot.

        When you moved house, did you notify the DVLA?

          I didnt have to as the car was sold at the same time. I havent owned this Car since July.

          What I can't grasp is the fees that Marston are charging. When I spoke to the Bailiff he said unless I pay up by Monday they could double. It feels like a mugging

              That is pretty much what it is - a mugging in slow motion.

              I suspect that, in your case, Marston's mutton-headed mugger^W bailiff has added on a "van fee" even though he has never levied on any of your goods.

              Remember one thing:

              Bailiffs tell lies.

                Thanks guys, so what is my course of action come Monday.

                Do I pay up, or do I complain to the Courts and the Bailiffs, or anyone else for that matter.

                Are they trying to charge me a Van Fee, and are they allowed to do that if I have never seen or heard of them before? I notice that the legislation for Parking Fines look like they favour the Bailiff company?

                  If you want to pay this then do so, but you are not obliged to pay a penny since you did not know anything about it.

                  I thought we had already established that you were going to file the statutory out of time? This would be the correct course of action together with not allowing the bailiff entry to your property should he actually visit you tomorrow as per my bailiff guide Bailiff Guide - Legal Beagles Consumer Forum

                    Hi again,

                    So I contacted the Magistrates directly only to be told that this is not a Magistrates issue, its a County Council civil matter. The debt was registered with the court, but thats all and Swindon Parking fines are never dealt with as a criminal action.
                    I was then told to check the charges the bailiffs as I should be charged in line with 'Schedule 2' rates of fees.

                    Does this all sound correct?
