Hi, I am new to the site and wonder if anyone has ever come across my dilemma. I rent my property, unfurnished, from my ex partner. He recently received a London congestion charge penalty notice for a vehicle he does not own. The DVLA made an error as registration is same but for 1 character. Because of this my ex partner is refusing to contact TFL saying it's not his problem. Trouble is, they think he lives here as he has never changed his address. I am afraid Bailiffs will come to demand money from me and I will not be able to convince them that the contents of the property are mine. Any advice on this matter would be most welcome :tinysmile_cry_t:

I would suggest that you have two options. The first is to return the letter to TFL giving your ex-partner's true address.
Secondly you could just return the letter saying unknown at this address. Finally (the third of my two options lol) you could write to TFL explaining what has happened and that as a single woman who is vulnerable you are scared of potential consequences. I'd go for the last!

Thanks Labman But ex partner collects his mail I do not open it and so do not have the ref no of the penalty. I offered to send it back to TFL for him, but he took it with him, our daughter has since told me that he believes it will just 'go away' although now he has had second letter from them. I am not frightened by the prospect of Bailiffs persay, just how do I prove that the contents of my house are mine and not his. Would my tenancy agreement with him dated and witnessed in 2007 be accepted I wonder ?

Or you could just write to TFL anyway, pointing out that your ex no longer lives there, he just collects his post and you have no idea where he is living now, or if you do know, then tell them. You could do an affidavit to this effect, also stating that none of his possessions are in the house. Point this out in the letter to them and stress that if any bailiffs turn up they will not be granted entry and the police will be called.Is no longer here

Thanks to Labman and Wendy for their advice. I finally persueded ex to return the original letter from TFL advising them of the reg error. He had a reply last week from TFL apologising for any inconvenience.
Who would have thought it could be that easy ?
