  • PPI Marks and Spencer


    Evening All, Brand new member here, if anyone can help/advise? I have been refused by Marks and Spencer Charge Card re PPI, firstly as been a customer for 24yrs and secondly I completed the form myself.. even though they strongly advised to tick the box for PPI I clearly don't have any proof of this! BUT their other argument is they sent me forms stating I could cancel PPI if I wanted!!!! Any thoughts? Or do I try the Financial Ombudsman Service?

    Hi and welcome to Legal Beagles.

    Did they confirm if it was the final decision?
    They should also confirm if your eligible to complain to the FOS in the final decision, if they have not then I would give it another shot of writing to them again, and give any further information.
    Tell them as a valued customer for over 24 years, your disappointed that they rejected your complaint, as you believe you have a genuine complaint and have reasons to make a reclaim on the PPI.

    Ask them to reconsider by giving them any further information, and ask they let you know by 14 days, tell them you will otherwise take this matter further.

    If you hear nothing by 14 days or if she stick to the same decision, see what your grounds are for complaining to the FOS, as I am not sure if that business were regulated when you taken out the account.

    The FOS are only able to take on complaints if the business your complaining about were regulated FSA/GISC at the time you taken out the account.

    However, if this is the case you could still contact the FOS and they may suggest the Underwriter/insurer avenue of the policy as another direction to take.

      Thank you for the reply. Yes, unfortunately they did say was final decision and to contact FOS. How would I go about finding out if they were regulated by FSA/GISC at the time? My thinking would be no, simply because of the lenght of time?
      But I will try the FOS with the hope of better luck..

        Hi Scoobs

        Your very welcome.

        The letter you received should confirm this one way or the other, they should let you know if your able to make a complaint to the FOS by confirming this in writing, and by enclosing a leaflet on how to complaint to them.
        Or they should let you know if your not eligible as well, and it should be confirmed one way or the other in the final decision.

        If this has not been mentioned on the letter, you could write to them again as above by giving the 14 days to get back to you, otherwise if you contact the FOS now, they should let you know if they are able to adjudicate your complaint or not.

        If the're unable to, its possible they will suggest the underwriter, but see what is what first, with the business or see if the FOS can help with this case.
