    My problem started when I recieved a letter warning me that someone with my name and address was trying to get credit cards and loans and I should phone this number to sort it out. The company was called Link Financial, so I called them as this worried me. After some security questions I was then passed onto someone else who started warning me that they owned an MBNA debt dating back to 2003 and I should pay it immediatly. I told them that the debt was taken on by a company called Wescot and they have had it since 2004 and because of my financial predicament I have been paying them £5 a month without fault. I have sent Link proof of this but they are having none of it. They have sent me letters stating when a last payment to them was made but I disputed it and asked them to send me proof they actually owned this debt but they have not, they claim its another debt but I know there was only one credit card and one debt. All is quiet at the moment but I dont know if that is just the quiet before the storm. Could someone please advise me on my legal rights and how I can get this company to leave me alone I cant even remember them.

    Hi and welcome Sharnie

    Send link a DSAR (Data Subject Access Request) with a £10 postal order (which is the statutary fee) to find out what they all have on you (you will find a SAR/DSAR in the site library)

    with this request they have/supposed to by law give you copies of every scrap of info that they have about you

    there is a high possibility that they are trying to chase a debt that is staute barred (which means the debt can't be enforced not even in a court of law) or it is a debt that they do not own but we will not know this until we recieve or not recieve a reply to the DSAR

    Also DO NOT talk to them on the phone as you have no proof of what has been said, keep everything in writing. If they phone you then just tell them politly to put anything they have to say in writing as you will not talk on the phone about such matters.

      Sorry Gorang, but a simpler and cheaper approach would be a straightforward Prove It letter rather than potentially wasting £10 on a SAR. there really is no need to SAR a DCA at such an early stage, if at all.

      There's a Prove It example in post #4 on the first link in my Siggie.

        I am so glad I found ths website. Thankyou for your advice it is such a relief to know that there are people like you who care. I try not to let this whole thing get to me but its very difficult. I will let you know what happens.
