    Hi There,

    I am a housewife who has found herself in the middle of a nightmare desperately seeking advice.
    I have had some experience dealing with companies and complaining but I am now at a loss as to what to do next. I don't know if I am supposed to outline my problem here...
    In brief:

    I am being chased by Lowells for £110 that has been paid. I have provided the company with a copy of the cheque that is missing from the original payment list and a copy of the bank statement showing the cheque clearing. The photocopy of the cheque clearly shows a bank stamp from the Natwest but they are saying that I don't have a reasonable dispute and they are threatening court action.

    I should mention that this dispute has been on going for over 4years and has now been dealt with by 4 different DCA's.

    Needless to say I am bored now.

    Do you have a copy of the front and back of the cheque?
    Have you asked NatWest to trace the cheque because the recipient is claiming non payment?
    If you have done and have the reply from NatWest then you have a defence that will make Lowells seem absolutely stupid.
    Are the making phone calls to your home? Keep a log of them. Have they defaulted you?

      I have a copy of the front of the cheque, not the back. We were asked originally for 3 cheques to be provided and they only asked (verbally) for the front. We obtained this from Woolwich (who the account was with ). We then got a letter requesting for the front and the back of the cheque but Woolwich then said we would have to pay for that and as we had provided the front , plus the bank statement showing it was cashed and the cheque stubs etc etc we never got the backs. The DCA at the time did not persue it and we didn't hear about it for over a year until another DCA was involved. I did honestly think it had been sorted.
      The money came out of an account with the Woolwich and was banked by the DCA in a Natwest so I didn't think I could trace it any further with them as the money went into the DCA's account which surely the bank can't give me information about .
      I don't know much about banking but as I understand it the Woolwich were able to give me a copy of the cheque because when a cheque is paid it gets returned to the issuing branch and held on file for a while before it is destroyed.
      We don't get phone calls as I have already put a stop to them but we get many letters regarding this.
      I don't know if they have defaulted us? they have always said that the account is on hold until this is resolved. We have NEVER agreed to pay anything, always denied the debt and provided copies of everything.

        Ask Woolwich/Barclays to either provide details of the account number/sort code the cheque was deposited to or provide a copy of the back of the cheque since the recipient is denying that they received it and are threatening you with legal action(regardless of whether that is true or not).

          Verytired,

          My opionion only, but if you are addament you have paid it and have the proof send a last chance letter telling them that it is paid inclose the proof again and state if you are not happy I invite you to take me to court.

          As leclerc says they will look mighty stupid in front of the judge. It will also be two pronged as you can claim damages from them for the stress etc they have put you though.
          If you think nobody cares if you're alive, try missing a couple of payments.
