    Hi Everyone, just new to this forum, can anyone help me? I went onto sick last September after working full time for 39years, i have severe RA, i went through the usual Athos Medical with the result of zero points, i apealed and went to tribunal on 6th May this year, prior to tribunal i submitted all paper work from Rhumatologist's and O/T, anyway i was only in the tribunal for 5mins i was awarded ESA with support Regulation 29 2 (b) and 35 (2) applied.
    Me thinking that was that for probably a year until another Medical, i was shocked to receive an ESA 50 to fill in two weeks ago and another medical on the 15th of this month, what is the point of Tribunal when this happens? can anyone tell me if they have had the same.

    Hi Snadger and welcome to Legal Beagles :beagle:

    although different circumstances to yourself I too had problems with getting ESA had a total hip replacement done end of January this year, prior to that I had great difficulty walking as my hip had completely disintegrated and I was on major amount of painkillers just to get through the day. I had I medical where I was seen by a nurse and then just a few weeks later I had to go back and see a Doctor, he was shocked I had been called in again, as it takes about an hour to get to the centre and was quite painful getting in and out of a car, as they should have known by the form filled in previously with the nurse I was unable to work, but alas they still did not award me ESA. then again I was called in and lo and behold they had on the form that I would be able to work in 3 months, stilll hadn't had the op by then ???? they then decided I would get ESA after I called and complained, a few days after operation I had the forms to fill out again and have been in twice since the op.
