    Hi,

    I have CapQuest on my back. They bought a debt which I know is over 6 years old. I wrote and asked for a SAR, which they ignored and sent me a Letter Before Action. I replied to this asking them again for the SAR, a copy of the Credit Agreement (fee £1) and the Assignment Document, all posted by PO reg mail. Since writing they have now replied to my first SAR request demanding £10 for admin charges and Proof of Identity!!! I feel that as they now want my identity all the threatening letters have been verging on Blackmail (see Theft Act 1968. sec 21)

    Any advice anyone

    You say this debt is over 6 yrs old, have you paid anything off this debt in the past 6 yrs?

    A subject access request has a statutory £10 fee did you send this with the request?

    There is nothing in law that says you need to provide ID, if they are happy writing to you at the address they used that is good enough ID

      They are tricksters at CapQuest. Make sure your SARS and CCA payments do not activate your 6 year old accountl

            Can you tell us exactly what you mean by that?

            Was there ever a period of 6 years or over (5 if you are in Scotland) during which you neither acknowledged the debt formally in writing or made a payment on it?

            If so, then the debt would be statute barred and there is little point messing around with SARs/CCAs etc.
