  • OH v Littlewoods

    Hi

    Have an ongoing issue with Littlewoods/Shop direct which OH would like to settle........ at the right price.

    Last statement dated July '09 had balance of £790.00, she wrote to Littlewoods in May this year asking if interest was still being applied and if she could have a settlement figure. After 3 months of chasing we finally receive a response with a balance of £1680.00.

    No statements, no default notices, no nothing since July '09. Have sent back a response that we would like breakdown of charges and copy statement for July '09 pursuant to CCA amendments 2006 for any/all interest charges for the period.

    Have today received their final response advising that statements continued to be sent every month by royal mail and its our problem if we didnt receive them.......... still no copy statement!

    Any ideas on how the OH is going to settle the account...... and, yep CCA is a goodun from October 2007.

    I know we can go down the route of reclaiming charges via CC but can the same also be said for interest encumbered when in breach of CCA?
