    Hi everyone, my name is Lindyloo and I am new today. I am urgently looking for advice regarding a 3rd party using our residential address for business purposes. Can anybody help??

      Hi Lindiloo,
      Welcome to the forum.

      I would advise that you report them to your local council, as unless you have regestered the address as a business address they are in breech of contract and not allowed to trade without licence and need your written permission to obtain one as it is your property.

        Thanks for the reply. We have found out that they have opened bank accounts using our address however the bank states that as they have a duty to their customers and the customer in this case insists they OWN AND LIVE at our address, they are unable to act further. The people in question have letter head paper printed with our address on and have advertised their business in the Yellow Pages and online, again with our address. Our solicitor last week advised we contact the police, which my husband did last night only to be told by the police that they are acting within the law and only if the man claimed to be my husband by name, would they be breaking the law. The problem is that the people in question are on a caravan park but have the same postcode. We have evidence already that our very good credit rating is being affected. We really don't know which way to turn!

          Hi Lindyloo,

          Personally I wouldn't let this rest, and I would be sitting in that Police Station insisting on seeing someone from CID and I would refuse to move till they saw me.
          I would suggest that what they are doing is actually fraud and I would mention that point when you talk to Mr Plod. Also when Mr Plod spoke to the 'offenders' did they ask them for absolute proof that they owned and reside at your address, and much the same did the bank also.
          We have a small business and we also work from home (although we are now looking for offices) and when we started up we had to prove that we owned and live here, the bank wanted headed paper AND copies of our passports, driving licences (the paper copy not the credit card size one) AND two utility bills with our names and address on.
          I would suggest that when you talk to the policeman to ask them if they could find out if any or all of those proofs of i.d. were given.

            What evidence do you have regard your credit rating?
            I would suggest you get a copy of your credit reports then file a 'disassocistion' with the other party.

            So are you getting all their mail then? presumably it is all coming to your address.

              I agree with you Sapphy, people cannot or should not be able to get a bank account opened using someonelses address and name.

              My O/H had that a few years ago and it affected his credit rating until he was able to sort as someone purported to be him and tried to open a halifax account. The only thing here is they did not give our address they gave an address 30 miles away. when the bank asked for the proofs as sapphy suggested they disapeared. They also did not get the security questions right as my o/h had had an account with them which was laying dormant.

              He did eventually get this link taken off his credit rating but it was a lot of agro.

              You must be getting the bank statements arriving at your home.

                Are they using your name? or only your address?

                I suggest that you write a very strong letter to the bank concerned, hand it in personally and get a receipt for it. Point out that you may well share the same postcode but you live at number xxx and they actually live at xxx caravan park down the road. Take proof (such as utility bills, council tax statments etc) that you live at this address, not Mr whatshisface.

                They may have changed to online statments so you might not get any paperwork for them sent to your home.

                Also do as PK suggests and file a Notice of Disassociation with all the credit reference agencies.
