  • Tennis Racquet Purchased At Sports Direct

    Firstly,I'd like to say hi to everyone.I'm a new member.My 13yr old son bought a Dunlop tennis racquet (£15.00) from Sports Direct recently after having saved up all his money.Excited,& wanting to use it ASAP,he,unfortunately didn't keep (or lost) the receipt.After a few uses,the grip came off the racquet after the base cap came away from the handle.I took it back to the shop asking for an exchange,to which they refused.I have been led to believe that stores are obliged to exchange faulty goods even if the receipt can't be produced,although I know that stores do not usually give refunds without receipts,in my experience I have always received an exchange for faulty goods even without a receipt.What are my legal rights here?       Not having the receipt is not important. The Sale of Goods Act 1979 does not specify that the trader must give you a receipt in the first place so it would be unfair to say that you had to produce one.

      You are entitled to an exchange of faulty goods and you must not be fobbed off here. Take it back again and demand an exchange and if they refuse ask to speak to the manager of the store and inform them that you are claiming your rights under the Sale of Goods Act. If they still refuse to exchange the product, ask for a name and the address of their head office - is it these people?

      If they still refuse to exchange the product, come back here and we can advise further. It is important that you do not give up, you are entitled (and more importantly here, so is your son) to a product that is fit for purpose, of satisfactory quality and free from defects and these entitlements are enshrined in law.
