Racially aggravated offence

Hi all,

Apologies for the random legal question, but I’m asking for some advice on behalf of someone I know.

During a dispute over a back-garden fence, their next-door neighbour told them to "go back to where they came from". Could this be reported to the police as a racially aggravated offence? And if so, is it possible for the police to refuse to investigate it?

Q1. Yes. You can report anything you want to the police.

You may want to be able to say very much more if you intend to report a hate crime.

The case I was involved in was more a case where the Police should have "had a word" about what is acceptable and what is not. If it were to happen again of course...

I have now heard back from the person I know who is involved in the matter. The police phoned for an initial conversation about the incident. The police constable said the racial remark was made in private gardens between two parties, and he personally did not think the police could do anything about it. However, he added that he would check with a more senior officer (not sure what they're called, sorry!). Hence I posted this thread.
