  • PreAction via broker chasing for claimed loss of commission

Hello. I’m new to the forum and unsure where best to post this, especially as it touches upon a few areas. I’ve tried to give a brief overall picture without going too overboard.
    1. My late mother's energy contract (for a lettings property) goes live in Jan '25; she passes away in Feb '25. As executor, I contact the energy supplier who instructs the account & contract must be closed and a new one opened in my name.
    2. Mid-April 2026, PreAction (PA) makes contact on behalf of the broker — initially addressed to my late mother — alleging breach due to a "duplicate contract fee" clause, whereby a customer enters another contract with another supplier, causing the contract facilitated to not proceed to live status. Claim is for approx. £2k. Incidentally, yesterday's Notification of Intention letter introduced a new claim — "failed to successfully commence or remain in place for the agreed contract duration" — the latter has not been raised before and isn't found in the original claimed breached T&Cs.
    3. Mid-April ’26, I inform PA by phone of her death (made no difference) and state I'd still seek legal advice; they respond same day with a payment demand. From there on I wait for written correspondence only.
    4. Early May ’26, PA sends “Letter Before Action” letter, which I dispute in writing by the set deadline making clear the contract clearly proceeded to "live" status.
    5. Early June ’26, PA sends “Claim Form Cover” letter and a mocked-up “Court Claim Form” both lacking a Claim No. or Issue Date. The form also cites the defunct "CCBC" name rather than CNBC and there is no official seal. My dispute letter is also unacknowledged; I confirm receipt in writing reserving my position due to non reply to my dispute letter.
    6. Yesterday, PA emails a Notification of Intention letter, threatening the Customer will apply for the issue of a default summons within 7 days of the letter — still no acknowledgement of dispute letter.
    7. Throughout, any correspondence asked from me has been asked to be routed back to PA only.
Any thoughts on possible next steps? Do I have any open to me?

As I understand, a default summons should require submission of a prior Court Claim Form and a failure on my part to respond — incidentally I've received no official claim pack to date. So despite what CNBC told me, is there a way to verify whether an actual Court Claim has been submitted? As of today, TrustOnline shows no CCJs as I somewhat expected.

I've also considered lodging a formal complaint directly with the energy broker, ensuring PA is notified too. Is there any merit to me taking this action too?

Thank you for in advance for any advice.
