  • Estate shares

My mother passed in August 1997 the house i live in was purchased by my Motherand myself and in her estate (my mothers 50%) half of the home was left to myself and my 2 brothers ,

recently one of my brother has received money from myself to the sum of £2500 and said he wishes to relinquish (think that's the word) any other money owed in regards to his share in the estate left by my late mother.

do i need a legal document from a Solicitor(yourselves) for my brother and myself to sign in regards to this matter or is is something i can do myself ? solicitos were the executors of my Mothers last will and Testament in 1997),
if i do need a document regarding this how much would this roughly cost and is it something that can be done by post ?

You would indeed be wise to instruct a solicitor to draw up suitable documentation. You should contact firms in your area and ask for estimates of the cost.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Depending on the value of the share to be transferred there may be tax implications that you both, but particularly your brother, should be aware of, capital fails tax and/ or ( in the future) inheritance tax.

I’m assuming your brother does not live in the house he part owns. There may also be stamp duty to pay depending on how the transaction is characterised.

Accordingly, I agree with Atticus, take proper advice.
