  • Sending a statutory fee to a Claimant based in Luxembourg Urgent help needed please

    Hi
I'm really stumped here and am running out of time, any help would be appreciated.

I have a claim against me for a credit card debt and the claimant is based in Luxembourg. I am requesting my credit agreement but can't find anyone with a chequebook to pay the £1 statutory fee. I have tried everyone I know and they have tried everyone they know!

I can't find any details about the company to make digital payment, no website, email etc.

What can I do in this situation?

    Thank you in advance

Have you asked them for the CCA? Have they said you need to pay them the statutory £1? Is there no way to contact them at all? Surely if they have started a claim against you there must be something in their claim documents that identifies how to contact them?

When you say they have a claim against you have they actually started formal court proceedings against you or are they just writing threats to you?

It seems unlikely to me that Luxembourg company would bother to ask for a £1 fee by cheque. It would cost them far more than £1 to process a cheque from a British bank. They'd be out of pocket!

Yes sorry this is a claim from the court, I have acknowledged the claim and want to send the cca request.
There is no other details apart from their address and I can't find any details online at all.
I appreciate that they wouldn't process the cheque due to their own fees involved but do not feel comfortable not giving them the option as they could perhaps use it as a reason to not fulfil the request.

If writing to them is the only way to contact them sellotape a £1 coin to the request letter? A bit unorthodox but it might be a work around for you!

Use the address given for the Claimant on the Claim Form. Send a postal order for the fee.

Yes, Atticus's suggestion is much more sensible than mine! I didn't realise that Postal Orders still existed.

Thank you but I don't think postal orders work overseas

But, even if that is correct (I have not checked), the claimant's address for service shown on the claim form should not be overseas.

That's interesting thank you. It definitely is an overseas address on the claim form. I finally managed to find a cheque so have sent it to that address.

I've done priority tracked so will see what happens.

Thank you very much for everyone's suggestions.

There is an address for an acting solicitor in the UK but I understood the claimant was where the cca request should go.

I did include a copy of the cca request for the solicitor in the 31.14 request to them.

Hopefully that is ok but feel free to correct me because it's more than possible that I am wrong!
