  • What rights do i have?

    Hello,

I need some help with my emplyment rights...

I have worked for a semi-professional football club for the last 7 years as an assistant manager of the first team. I have never signed an employment contract but have been paid via PAYE and have received pension contributions. My working pattern has been consistant through my employment being paid through the football season and then not being paid during the off season. I was also furloughed by the club and was paid during this time.

The football club are now going to a full time model and have asked me to leave. They havent given me any notice or severance pay...

How should i deal with this situation best?

    Thanks...

    Hello and welcome to LB.

Even if you do not have a contract of employment, the fact that turn up for work for 7 years and you are then paid for this work via PAYE, means that an implied contract exists.

As you have been there for more than 2 years, they cannot just ask you to leave without either a fair reason e.g. capability, redundancy and having followed a fair process.

You are also entitled to 7 weeks notice pay.

I would suggest you write to the club:

    1. Asking them to confirm in writing they have ended your role and the reasons for this.
    2. Requesting your statutory notice, which is 7 weeks
    3. Requesting payment of any accrued holiday pay.

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.

Thank you, just to clarify the roll was part time hours and the reason they have asked me to leave is they want to make my roll a full time position (I have a fully time job along side this part time role)
