    Hi,

    my son has been on a membership with my wife but has now turned 18, they have been pestering him to change the membership as he is classed as an adult

    he went today and even though he asked if his mum could be there they've signed him up to a new membership, he didn't even realise he had signed up for 12 months until I checked his e mail just now

    my question is, does he have a right to cancel this as he didn't want it but thought he was paying the initial £40 for this month only and not signing up for £70 per month for 12 months

    my view is that he has been mis sold and taken advantage of even though he explicitly asked to do it with a parent present

    what are your thoughts please?

    your son is an adult and more that capable of refusing a contract. Probably time to stop checking his emails and let him take care of things now.

      Thanks Baz, not very helpful, having spoken to him further, he asked them to prepare the paperwork but wanted to come back with one of his parents, yet they continued with the sign up process despite his express request for a parent to be present

        he could of refused. Does he have special needs that would require a parent present?
        Is there a cooling off period?

              sorry im not posting what you want to hear but they are valid questions ans your son is an adult not a minor. If he has special needs then that might change your options.

                If you go to their website, under 'Help' they give you options, use feedback to write a Letter of Complaint.
                Explain exactly what happened, your son made a request, so you could run through the agreement with,
                him, but they carried on 'regardless' etc. No doubt they will say this say that etc, but make your case.

                  Thanks ECHAT, I’m going to have a meeting with the manager tomorrow
                  its the principal of it for me, you ask to be able to go back with a parent, but they still press ahead knowing full well that if you sign up on site you are pretty much handcuffed, he wanted to back out when asked to put his bank details in but was too scared/ nervous etc
                  there should still be a cooling off period for this type of thing

                    Is your son going with you to see the manager? It's his complaint not yours and unless he has provided the gym with permission to discuss his membership with you it would be a breach of his data protection rights for the gym to do so.

                    There is no statutory cooling off period for contracts signed at the gym premises. The gym can allow a cooling off period in its Terms & Conditions. Has your son read their T&C to see what they say about this?

                      He shouldn't be 'pressurised' in signing a contract.

                      The reception or whatever Bannatyne reception has, might have CCTV, send them a SAR request.

                      Adult's sign contracts all the time, 60M to 64M signed PPI contacts, apparently they shouldn't have signed contracts with PPI.

                        I would be furious if this had happened to one of my kids. 18 year olds are not worldly wise and still need steering when it comes to things that you or I might understand easily. I would also be complaining and the pressure issue is valid in my opinion.
