Hello,
This is a bit of an unusual query, I have searched the internet and havent found much on the subject.
A little back ground, I live in a remote part of the Highlands, I had several businesses that I built up over the years from scratch, each generating decent turnovers. 3 years in and I had a messy split from long term partner, this devastated me financially which eventually led to my home being repossessed this year.
On the day of the eviction I had moved out prior to the Sherrif Officer and locksmith arriving.
There are 2 seperate title deeds that adjion my property, one of which I own that has my work shed on it. This land has a seperate title deed to what my mortgage company has security over and formed no part of the court eviction writ.
My work shed is full of work tools, on the day of the evition I had secured the shed by screwing a sheet of plywood over the door to prevent any entry.
I drove past several times during the day of eviction, I noted the Sherrif Officer left after about 2pm and the locksmith(s) with his large van left just after 5pm when it was getting dark.
I appeared back at 6pm to check on my workshed and to my absolute shock, the shed had been entered into and another door had been fitted with a padlock.
I also noticed immediately that approx 8-10 part worn SUV summer tyres sitting beside my shed, that I had previously stacked neatly that morning, were all gone!
The shed could be explained in that it was probably a mistake by the Sherrif Officer thinking it formed part of the house deeds, but the theft of old tyres?!
I did not force the shed door open thinking I might be breaking a court order, even if it was a mistake.
I checked my shed the following day to see if anything else had been stolen (not by the padlocked door) and was surprised once again, several other items and tools missing, not anything of great value considering the value of tools i had the shed.
I contacted the mortgage providers Solicitor who instructed the eviction immediately the evening of the eviction, I waited a week but got no response.
I then contacted SMASO a week later which took 6 weeks for them to respond with a reply from the Sherrifs Officers involved, they denied instructing my shed to be opened up and secured with a padlock.
They also denied and the theft of my belongings even though it was quite obvious in my email that the thefts were hardly commited by the Sherrif Officer as 8-10 large and dirty tyres could hardly fit in their small car!
The Locksmith(s) or their actions were never mentioned in their response. The response was simply to deny all knowledge and SMASO didnt do more than act as an email forwarder.
I sent another email to SMASO last week asking if I could get the key to the padlock to retrieve my tools, this has gone unanswered, not even an acknowledgment email.
I feel quite angry about this whole situation considering the circumstances and those involved and especially being fobbed off by all concerned.
I have not contacted the police yet as I know they will do nothing and ill have the embarrassment of them turning up.
Any pointers or advice?
Many Thanks
PS, To rub salt into my wounds, my new accomodation is a caravan....one of the items stolen was a caravan leisure battery I had just purchased for said caravan
