    When you contacted the council's Insurers did they say they were aware of a vehicle accident and claim at your property?
    If they said yes and are waiting for you to forward rebuilding quotes there is no need for you to start a legal expenses claim.

      You might like to bear in mind that if you claim against your own insurance, your insurers will appoint the builders they deem suitable (not necessarily those you would prefer) and will only pay the cost of reinstatement.
      If you proceed against the liable party, what you are suing for is loss of value to your property.
      This is generally accepted to be the cost of reinstatement by builders of your choice(within reason), but you can also include in your claim cost of your time dealing with the claim, loss of amenity and anticipated cost of reinstating the garden after builders have trampled all over it!

      How do I know ?... last year someone demolished part of my boundary wall... 200 years old stone and lime mortar.
      There was a certain amount of discussion between me and the loss adjusters before they settled at a figure acceptable to me!
