  • 2018 ccj

    good morning everyone.
I found this site looking for help and advice, what a fabulous site this is everyone is friendly and helpful. Please bear with me I’m new to doing this so I’ve not found my feet yet. I have a ccj issued march 2018 had an orbit field agent visit my home on Tuesday morning. I didn’t answer so he put a letter through my letter box asking me to get in touch, which I haven’t. I don’t know the way forward from here not had much sleep either due to this and recovering from surgery. The debt was purchased by Cabot in 2017-2018 any help or advice would be much appreciated. Thank you.

Ignore them. Orbit are just debt collectors and have no legal powers to do anything. You do not have to speak to them and I recommend that you don't. Orbit are owned by Cabot, they are Cabot's in-house debt collecting company.

If they come to your door when you are at home don't let them in, or tell them your phone mumber or email address. Tell them you will not discuss anything with them face to face and that if they want to discuss anything you will only do so by post (Royal Mail). Then ask them to leave and close the door.

It is safe to confirm your identity because that stops them using an old address to serve court documents, which you then might not see. If you've moved since the CCJ the reason they called might be to try and get confirmation of where you now live.

Ensure that everyone else living in your property knows what to do (debt collectors are not allowed to engage with under 18s).

As far as the CCJ is concerned the debt owner is no longer able to enforce the CCJ after 6 years unless they go back to court and ask permission from a judge. They would have to show a good reason why they did not enforce it (eg send in court bailiffs) during the 6 years since the CCJ. They can still try to persuade you to pay (eg sending Orbit round) but if you don't pay there is nothing much in practice they can do about it. The debt still legally exists but cannot be enforced without a new court order.

Your CCJ from 2018 is well over 6 years old. If the current debt owner did go to court to ask permission to enforce (unlikely) you would receive official notification from the courts and would be able to oppose their request.

By now the CCJ should have been removed from the national register of court judgements TrustOnline: Search the Official Register of CCJs & Fines and from your credit agency records. You might want to check those and make sure the debt and CCJ is no longer appearing.
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.
