I am being chased by Pixsy for £250 for the use of an image I had on my website, which I had sourced under the Creative Commons licence, and when I downloaded it from Google wasn't aware of the complex accreditation requirements that would make its use genuinely free.
Investigation into this company suggests that it's really a scam, where this photographer Marco Verch has millions of his stock style images online under the Creative Commons licence, and then when people don't credit him properly he uses Pixsy and other agencies to aggressively pursue people for a licence fee to use them.
Reading other threads on here, it seems that this is legal but outside the spirit of the CC licence, where you may have been expected to be sent a warning in advance of a demand for payment.
So I have been sent this demand, which I am unwilling to pay, and as I just happen to be in the process of closing down my limited company, I have been wondering whether this might be the best way out of it.
However, I would like some advice - if I close my limited company, am I then genuinely protected from any legal proceedings or costs Pixsy or the photographer might bring against me?
My accountant has told me it will take 3 months to close the company, so how do I hold Pixsy off until then? Are there any delay tactics that anyone can recommend?
