  • Entering stopping in box junction

    Hi can anyone help please, my partner was driving over a box junction when someone ran out into the road he didn’t fully stop but drove a lot slower to obviously avoid hitting them.
    in the photos we have u can see the car is moving as one picture it’s 9.58.17 & car is in one spot then at 9.58.19 his past that spot so he didn’t stop in the box just drove very slowly!
    do we have an argument here to not pay the fine as it’s £80 if paid in 14 days the £160 & it states entering & stopping in box junction but he didn’t stop he just drove slowly?

      Thank you I will have a look Iv requested cctv but I no this will probably take a while so I want to get the appeal in asap just not sure where to start or what to write.

        It's only an offence if (1) you stop, and (2) you stop because of the presence of a stationary vehicle(s).

        So if you don't stop there can be no offence. And if you only stop because a pedestrian steps in front of you, it still isn't an offence.

        You mention photos. Have you got a video of the alleged stopping? If not contact the authority and ask them to put the PCN on hold while they send you a copy of the video.
