I have lived in my house for 10 years. My garden was half the length of my neighbours and I often wondered why. Then April 24 I got a letter from Land Registry saying my neighbour was applying for adverse possession of the land behind my garden (apprx 70 sq m). they were letting me know as I was the legal proprietor. This explained why my garden was half the length of my neighbours - the other half was behind the fance. Anyway as this patch of garden and the neighbours patch was completely overgrown and derelict, I objected to the adverse possession notice from this point of view. In January 25, I heard that LR had thrown out the application....so I fenced it off according to my title plan dated 1966. The freeholder next door decided to sell some of his land when he lost so whilst he is still freeholder for the flats and their garden on the site, he sold the back bit which contains a block of 4 garages.
Anyway from February to June, I gradually built a patio garden on my new patch of land - decking, hot tub and surround etc. It was beautiful - a gift to myself for my 60th birthday. Then on 22nd September, I came home to find the boundary fence removed and about 1/2 metre of land hacked away. The new ownder whom I had never met or even spoken to before had seen fit to take a chainsaw to it. They had put up a new fence and wedged 2 untaxed and un MOTed cars behind the fence. The next day my daughter and her friend removed the fence they had put up. They called the police who came and said they could not get involved as it was a civil dispute....so for the last 2 months my hacked away garden has had 2 cars, a van and a mini digger wedged up against the boundary....anyway 2 weeks ago I asked a surveor to come and draw up a boundary determination report. I am awaiting the report. Meanwhile their solicitor set a letter saying of their intent to build a boundary fence. I replied saying they could not build a fence before the report was released. Today I came home and they had built a fence. The issue is that my title plan and their boundary plan show the boundary line differently. What do I do now?
