Hello, my father recently died. He lived in Scotland. He left a will and the beneficiaries are my sister and my daughter. He didn’t make me a beneficiary because he knew I would lose my home in England which is a charitable organisation and if you have capital over £30,000 you must move out. His legacy would exceed that and he didn’t want me to become homeless as I’m disabled. I’ve been sent a letter to say a daughter is entitled to claim on the estate or refuse to exercise that right, if I do I lose my home. If I don’t I may be deemed to be depriving myself of capital. I’m have a serious and risky heart operation in a month and can’t move. The stress is phenomenal and I wish I wasn’t in this position, not knowing what to do. Anyone with any ideas?

The policy of the charity providing your housing if they knew you had declined the inheritance is key.
Obviously you wouldn't want to ask them and alert them to the situation but is there anything in their agreement with you or in their published policies which defines deprivation of assets?
