  • Pharmacy GDPR breach special category (health).

Chemist accidentally handed my medication to my mum (in her 90s') instead of her own medication. The chemist failed to check the name and address prior to handing it to her. I have never gave permission for anyone to collect on my behalf. My mum then phoned me asking why I was taking strong anti-depressant medication? I am currently undergoing weekly counselling for PTSD and off work with stress. I have LPA for my elderly mum however she is now questioning if this should be revoked & potentially changing her will if, quote 'there is something wrong in your head'. My mum should not have been privy to my medication and this has caused me distress, causing a worsening of my existing mental health conditions. The chemist admitted their mistake and were apologetic and will update me on their findings.

So what is it you want advice about?

Yes a breach of your data protection rights and the pharmacy are not denying it and have apologised. But what has happened can't be undone.

What is it you want to happen next?
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.
