  • Parking charge even though I had a ticket

    Hi
    Carpark in Crewe has 20 minutes free. Was parked there for approx. 10 mins then thought it would take longer so went and bought a ticket for 1 or maybe 2 hours I cant remember.

    However I’ve just received a fine saying I have been there for 30 minutes without making a payment.

    I don’t have the ticket now as it was 2 weeks ago. The ticket was paid for with cash but on the machine it was one where you had to put your registration in, so surely there must be a record of it?

    So I had a ticket covering me for 1 or 2 hours which was purchased 10 minutes after entering the carpark and I’m also a blue badge owner, however the sign on the car park says blue badge holders have to pay anyway.
    What are my options if they’re saying I didn’t pay?

    Note that the claim is for "The vehicle was present on site in excess of the amount of time paid for/without making a payment" which is a menu of contradictory reasons
    As far as I can see your options are: (after searching for the parking ticket ... don't be so tidy in future .. we sometimes see court claims made 5 years+ after the event!)

    i) pay (and they will go away)

    ii) send a Subject Access Request asking that they specifically recheck their records as the driver recalls clearly paying (and they will say they have no record of your payment)
    Don't identify the driver. Just say "the driver recalls..." This will leave open your options for disputing the charge if that is your wish.

    iii) Send them a letter along the following lineswhich they will not accept as a valid argument. You can then tough it out, and possibly have to defend a court claim)

    Dear Sirs,
    I have received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing" to inform the keeper ..........that the parking charges have not been paid in full" as prescribed by section 9 (2) (b) of the Act.
    It is also noted the notice fails to describe clearly the circumstances in which the requirement to pay the charges arose (section 9 (2) (c) of the Act).
    Further it does not "specify the total amount of those parking charges that are unpaid, as at a time which is—
    (i)specified in the notice;"


    You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.
