  • DCB Legal - AOS - Out of Time (Help Please)

    Hi All,

    I received a letter from the court dated September 24th stating that DCB Legal, on behalf of their client UK Car Park Limited, would be pursuing a claim against me.

    Unfortunately, I was away from home while my kitchen was being renovated and only recently had the chance to go through my mail. I realised I missed the response deadline, though I have since submitted an Acknowledgment of Service (AOS) via Money Claim Online, albeit late, as of today.

    Is there anything I can do at this stage? I understand the court is strict with deadlines, but I’d like to avoid receiving a CCJ if possible. Would it be appropriate to request that the court overturn or set aside the judgment? Any guidance would be greatly appreciated.

    A late acknowledgement may be considered by the court if a default judgement hasn't been requested.

    If a default has been granted, but you have a reasonable defence, you could apply for a set aside.OR

    you could pay the award within one month so that there is no affect on your credit rating.

    Do you think you have a viable defence/
    Would you care to pot up a redacted copy of the charge notice & court claim?
