    I have a question regarding probate n properties in foreclosure. House n 10 acres bout to go into foreclose over 45k$ DEBT.... Value is 160k. Brother n sister are by marriage same dad. His dad died 2013 n her mom 2021. Loan for 50k was taken out in 2008. Neither has filed for probate on either parent for anything. My buddy is saying since his dad died before her mom that his sister has won the property. But isn’t it based on what the judge rules … n let’s say he files probate n asks for property n she never shows up for any hearings how could she be awarded property.. SO my buddy should file probate correct? the sister hasnt filed and said she doesnt want anything to do with estate .. no will or trust from either parent
