  • Sixt Car hire (Madeira) nightmare

    Hi ,

    first time on the site .

    I am embroiled with Sixt car rental in Madeira , who are claiming that I caused the demise of a clutch (supposedly through
    prolonged abuse ), leaving my wife and I stranded on the side of a busy motorway last February .

    It was the 2nd clutch in this Ford Puma which had 47000 kms ( 30000 miles) in total on the clock .
    The clutch was replaced at 39000 kms ie only 8000 kms of usage .

    Their collection agency in Germany is ramping up costs , and using intimidating language .

    They are also chasing me for used fuel , even after their check - in agent said (twice) that she would offset the
    fuel cost against the money we paid for a Sat Nav .
    The car we booked with S/N was not available , so were supplied with a Ford Puma without a S/N .

    Again these supposed fuel costs are also ramping up exponentially from a second ‘lawyer’ / collection agency in Germany .


    We only had the car for 30 hours out of the 48 hours booked for gentle sightseeing .
    The car was towed away and we were eventually taxied back to our hotel .

    No apology , no offer of a replacement from Sixt .


    My gut feeling is to throw down the gauntlet , and formally dispute the matter by telling them to go to the Portuguese Courts , who
    in turn would have to get a Civil case accepted and actioned by the UK courts .
    ( I have sent several emails to Sixt Madeira and their Customer care HQ , protesting my innocence and explaining the circumstances , but they
    all plead the party line ) .

    AI indicates that it would be extremely unlikely for Sixt to pursue these ‘pumped up ‘ costs through such a protracted and costly process via the courts .

    I am awaiting my insurance lawyers to contact me ; in the meantime has anyone else had such an experience , and succeeded ( or failed )in overturning
    a Sixt campaign of ongoing threats and financial penalties .

    Sixt is well known to us here for chasing all sorts of spurious claims. Let me guess, the debt collector is eCollect AG and the German lawyers they usually use are Themys & Dyke although recently we've seen them use a different German law firm called Radoslav Koychev. The good news is that despite all the legalistic shouting by the law firms we know of no case on here where any court action has been taken.

    It has been running since 2023 and at least 15 posters have reported being pursued by eCollect>T&D and been advised here to ignore all letters/emails from them. No-one has ever come back to say that any further action has been taken against them or report any court cases. Eventually the letters stop. You might reasonably conclude that ignoring them is unlikely to have any legal consequences for you, although as you say it would not be impossible for them to take court action if they chose to.

    In your position I would ignore everything from eCollect and T&D. The only things you should not ignore are a formal "Pre Action Protocol Letter of Claim" issued under UK rules of civil procedure [aka a 'PAPLOC'] or any document from a court. No-one on this thread has ever reported receiving either of those.

    I'm surprised that Sixt haven't just charged your credit card with what they claim is due to them. Do you know why they don't do that?

      Sixt did charge my credit card , but Halifax put a stop on them , and reversed the charges after I spoke to their Fraud dept and convinced them
      that I am certainly not the type to be doing wheelies and donuts along Funchal sea front
      Thank you for the comforting back- story - yes it is T D Rechtsanwalte for the clutch threats , and Astra Veritas / Advokat Radoslav Koychev
      seems to have adopted the lesser fuel payment threats
