  • Grass Verges

I bought a house last year that was constructed in 1966. The developer that built the house went into liquidation in 1977. No of those company members had any other company or set up any company since and the business address listed were redeveloped in the 1980s so we have no apparent method of contacting them or their descendants.

These developers are still recorded with the land registry as the legal owners of the grass verges at the front of my house and although as a neighbouring landowner i have an easement rights to access over and for my services to run through it, I am concerned that I have no other right.

I want to move my driveway, so will need to apply to Highways to drop the kerb, but have been informed by the neighbours that they will refuse as the landowners permission is required.

The road is adopted, the council do cut the grass occasionally but for the most it is the residents that do most of the maintenance.

What can do in this situation to get round this?

Have you asked the council formally to confirm the boundaries of the public highway when they adopted the road, and specifically whether it included the grass verges?
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.
