  • Under 18’s Employment Law

My son got a job whilst in the 6th form, he had to get authorisation from school that he could work there due to his age, 17.
he came home the other day and said they were making him redundant.
he was an order picker in a warehouse, there was 4 of them, needed to drop to 2, one left voluntarily so of the other 3 my son got the bullet.
apparently they did it on the basis of mistakes made in orders, he’d done the most hours but made most mistakes apparently.
no other criteria, I would have expected timekeeping and attendance too as he never missed and wasn’t late unlike the other two
anyway, he hasn’t received anything in writing about this at all and when I’ve asked about payslips he’s never received one in the 12 months he’s been there.
    1 should he receive payslips?
2 should he receive written confirmation of redundancy and what is happening?
3 is this some sort of sham redundancy?
4 he found out from one of his co workers that he would be paid a week even though he didn’t have to come in, nothing from the company, seems very unprofessional

I’ve tried to get information from my contact at the company but nothing has been forthcoming as yet, am I overreacting

    In reply to your questions:

1.Yes he should have been provided with payslips.
    2. Written confirmation of his termination by way of redundancy should be given to him as a matter of good practice.
    3. It would be difficult to say whether the redundancy is fair and reasonable. However the situation is that your son has less than 2 year service, so has limited employment rights and his employment can be terminated. There are a few criteria where automatic unfair dismissal could apply for less than 2 years service, primarily this is around discrimination on the basis of protected characteristics.
    4. What notice period is set out in his contract of employment re notice period?

Many thanks for your reply, he doesn’t appear to have any sort of contract.
his friend’s dad who works there got them the jobs ( his friend has kept his job despite poor timekeeping and reliability)
I asked his friends dad and his response was “they were just employed as young workers hence the permit,
doing casual work, giving them flexibility to do any hours they wanted. It was completely upto them, the role was more of a favour from me for them to learn some skills while earning some money. Due to the amount of them we have had to trim that down sadly”

he hasn’t received anything single piece of documentation relating to his employment, pay or “redundancy” this is the problem that I have personally, it doesn’t seem to have been done properly or fairly from the redundancy perspective
please let me know your thoughts
      many thanks

If you son was a casual worker then he would not have been entitled to notice to end his employment.

It is was due to needing to trim down staff then the company would not have needed to consult him as part of a redundancy process.

However some form of communication as I have said would have been good practice and he should have received payslips when he was paid.
