  • Marston have clamped a HP car now for over 3 weeks. How do I file an injunction?

    I woke up on the 13/08/25 to a clamp and notice on the car that were left at 6:30 for a PCN saying I owe £515. I contacted the ‘Mr Gray’ and explained the car was on a finance agreement so does not belong to me until the last payment has been made as per the contact and he was in breach of Schedule 12. He basically said I can’t tell him how to do his job, he’s 10yrs in, and can clamp it as I have beneficial interest, so I should just pay and hung up, then sent a text with the link to pay. On the same day, I have emailed the council who issued the PCN, Marston’s complaint email and I sent him a text with the first page of the finance agreement.

    I sent another email on the 28/08 explaining I would be taking legal action for compensation and referenced the case Burton vs MOJ. I also called Marston themselves, but the lady I spoke with said she would flag my complaints email to be looked into, but to the surprise of no one, all she kept mentioning was me paying what I ‘owe’. To date, the 6/09, I have heard nothing back from either. Would an injunction be next? How do I file one? And how much will it cost? For something that seems so straightforward in that they are doing wrong, getting help to combat it seems to be difficult.

      Sorry for the late reply, had no notification. Have not contacted them yet as I read that they could default the contract due to me ‘allowing’ the car to be under the control of a third party. Also to add, the HP agreement started last month, the car was originally on a PCP agreement, but the final balloon payment has been financed to now be HP.
