I have a multitude of health issues including severe COPD, Emphysema, Agoraphobia (for over 25 years) Depression, Severe Anxiety & I cannot use a phone, open letters and struggle with digital contact. I was evicted from a council property in 2019. I had inherited my childhood home after losing my father but i was grieving, suffering with a bad menopause on top of the heath issues i already had. I was overwhelmed and failed to inform DWP and ended up in arrears for council tax and rent due to over payment. I managed to clear these but in the meantime unbeknown to me several court cases had happened and the court costs led to me being evicted. The claim for possession of my then home, the council claimed i was in court and spoke but i was not even aware of the hearing. Three days after the eviction the council cancelled the Warrant for possession.
I was traumatised after the eviction as i was reassured by both support workers and council that ir wouldn't happen. Immediately after i moved the support was withdrawn despite requesting a further 2 or 3 hour visits as oi knew i wouldn't be able to set everything up with my issues with using the phone and opening mail but it was refused. Two months after i had moved i reached out for help emailed counciltaxhelp@cardiff.gov.uk and told them i was at crisis point explained my issues again, and asked for help. They just told me to contact bailiffs and contact council and go to the hub in the centre of Cardiff. Ignored everything i had said and told me to do what i was unable to do. I went back to my bubble and 5 years along the line was hit with an application for an order for sale. This was at the beginning of this year and i have forced myself to make and keep contact with the council. I must say i do not trust them. It has been a seriously hard year so far as i have had to do things that put me in a very dark place.
I had a charging order put on my home which meant that £8405 arrears were secured under that, there was a further £1200 odd on top, not secured.
I managed to get the total down to £7469 without any agreement and have ongoing full CTR. I sent all the documents requested and agreed to pay £200 per month although i would have preferred lower they insisted on £200. I set up direct debit and sent proof.
I then received a Consent Order that added almost £3500 to the total, wiping out any progress i had made and when i asked what for they just say charges and interest and insist i sign consent form digitally and return urgently. But i have serious issues with the Consent order which basically signs my home over to them without going back to court and sells my home and i pay for the whole thing. It petrifies me!
I have a support worker coming in an hour and i know he will insist on me signing, any advice please???
