    We booked a £1200 dog training course in Feb, fully expecting to complete by now, managed 2 training sessions, unfortunately we have both had some unexpected & debilitating health problems which are still ongoing and unresolved + 2 hr drive twice a day to make sure an 87 y.o. with Parkinsons + Parkinsons Dementia who had a bad fall & fractured a hip recently takes the correct tablets each day.
    Due to our ongoing poor health & no light at the end of the tunnel we have concluded we will not be able to complete this training course.

    I found the companies T&C/refund page, having read it I found the below clause.

    **7. Due to the nature of our courses, we cannot, in any event, pro-rata classes or transfer unused session time to another course or apply it to a refund. Courses are booked as a whole and are always priced at a discounted rate of service. Course refunds are not applicable.**

    Does this mean that they can refuse to refund some of the £1200 we paid?.
    I will add that the pricing structure was not made available until you followed the online link sent to our email address, nor were their T&C's & Refund Policy made clear prior to booking the course, in fact I had google search to find the links to the relevant sections.

    Can anyone enlighten me as to whether we could reasonably push for a partial refund minus any admin fees & training already undertaken.

    I found what I assume is their website and their T&C are clearly identified at the bottom of their Home page and headed "TERMS & CONDITIONS Once Payment Is Made, In Full Or Part, You Agree To Our Terms & Conditions".

    In my (non-lawyer's) view you would find it difficult to win in court but I wasn't able to see the exact sequence of screens you see when you sign up. Others here may have a different opinion.

    Their T&C also has this clause: "4. No refunds are available for non-attendance."

      O.K. they have Terms and Conditions, just because they have Terms and Conditions, it doesn't mean they are fair, they maybe 'unfair', so you need to go through them, to see if there are any 'unfair' terms. Only a Court can decide if Terms and Conditions are 'unfair'.

      When you cancel an agreement, they can only charge you for the actual losses they've incurred as a direct result of your cancellation, such as costs already spent or lost profit. Cancellation fees should be a genuine estimate of these direct losses and not just a standard charge regardless of actual damages.
