The council has applied for an order for sale on my property.
I have suffered with several health and mental health issues since around 2000 which caused daily problems.
In 2019 the council evicted me from a council property where I lived for 28 years.
I had inherited my childhood home when my dad passed away in 2016.
I was grieving suffering from the effects of menopause on top of my long term depression, Agoraphobia, PTSD, COPD, ASTHMA, panic attacks, anxiety which cause me to have a severe phobia of using phones, opening mail, going outdoors, general contact and even prevent me from using sms and emails when I suffer a flare up of symptoms.
I was in a black hole and unintentionally, i didn't notify dwp or anyone to be fair, due to this and ended up having arrears due to Over payments.
I managed to clear these but the court costs were added to my rent account and led to my Eviction.
In the process Tenants Support Team was referred to and also Floating Support.
MDT meetings were held to discuss my issues and possible solutions.
A district nurse visited weekly and also had weekly visits from a pharmacist but all ended when I was evicted.
The whole eviction ordeal was traumatic and I still suffer the effects even now 6 years later.
All support was withdrawn as soon as I moved.
I tried to explain to the support worker that I really needed 2 or 3 more hour/weekly visits as I wouldn't be able to sort change of addresses, setting up utilities, council tax, doctors, banks etc. but was refused.
Now 6 years later I am in debt for council tax arrears which have built up as I can't open mail, and always have a box full of unopened mail.
I did reach out to counciltaxhelp by email in September 2019 just 2 months after eviction saying I was in crisis and was told to phone here and there or go to town to the library for advice, obviously i couldn't use the phone and i do not go out and contact is the issue but totally overlooked as always.
The first I knew about the Charging Order and Order For Sale was 31st December 2024 when a friend was at my home to say Happy New Year, a large brown envelope was posted through my door and she insisted on opening it.
It was an application for an order for sale from the Council, and a pile of papers that it took around 10 days to actually read as i knew i really couldn't deal with this all over again. I was devastated and still am.
It has completely consumed my whole life every day and night for the past 6 months, I will not survive being evicted from here.
I grew up in this house, my mum and dad worked hard to buy it and the council want to take it for what amounted to £8400 plus £2000 which was later added for this year's council tax.
I now receive FULL CTR and it's backdated to 1 November 2024.
The CTR totals £2000 for this year's council tax and £780 for the backdated amount.
I have also paid £2200 off total since March 6 2025 which has been really hard being on UC and PIP Enhanced on daily care and mobility.
The council now wants me to sign a CONSENT ORDER for £200 a month, first payment under the 'agreement' being on 6th July 2025, after i sent relevant paperwork.
I am aware there is a 8% interest since Final Charging Order 3 January 2024
My balance was down to £7470 as of 6 June 2025 with CTR and my payments which totalled almost £5000.
But now on The Consent Order they are now demanding £10,885.57 for the arrears they say are now owing.
£8394.97 along with charges and costs assessed at £2490.60
- with no explanation for £3500 added overnight!
They state that if I miss a payment they will proceed with the sale, without any further reference to the Court.
Then sell my home for no less than £300,000.
*There is NO trace of ANY cases when I DSAR The Ministry of Justice.
*There is only an interim Charging Order registered on the Land Registry.
*There are NO markers or any CCJ when I made 3 separate Trust Registry searches, all come back green, with no trace.
*There is NO trace of the Case Number with The Courts in relation to this Case.
The council denied any evidence or proof of me being vulnerable.
However I sent a DSAR request and they knew.
I have now sent Medical records back to 2019, which were all I received after requesting complete and from birth if possible.
I was only given post eviction which only proved so much, I really needed the records from the previous GP as they had known me for 30 years.
My previous GP surgery and my recent GP surgeries have now formed a partnership too.
I have emailed to see what the problem is, had no response to the first email, have sent a second now and am awaiting a reply.
Since recently speaking to the council ILS have been referred to.
The 2 support workers that were meant to contact me were both sent to my old address,
the same Council that sent them there had evicted me from 6 years ago.
The lady knocked twice and then luckily somehow she had my son's number so she then rang my son who's my carer.
The other support worker 2 weeks later also knocked at my old address, and was also sent by the same council who evicted me from 6 years ago.
3 months ago I sent a complaint (before ILS was referred)
I said that knowing my issues I think they should have deducted the 1st liability order directly from my benefits, this would have prevented this huge debt.
They wrote back and said in a very sarcastic way that NORMALLY the defendant would correspond with council and provide bank details etc, and that they couldn't deduct from benefits because I didn't respond (I can't with my issues)
Welsh water managed to deduct from my benefits without contact, why can't the government?
They also claimed not to know my employment status BUT they have accessed CIS SYSTEM at least 30-40 times and it clearly says what benefits i receive and from when, again i have the proof in black and white as a result of another DSAR.
They mention my Vulnerabilities several times in the information I received.
This situation has taken over my life.
I spend hours every day scrutinising the papers.
It has seriously affected my mental health, i hardly sleep and when i do i wake up panicking, thinking some strange man is in my home and going to throw me out.
This feeling when you are Agoraphobic with PTSD is intense.
I constantly check my doors and windows are locked, several times a night.
I jump at the slightest noise.
I never open my curtains or blinds and constantly watch my camera, that watches my gate.
On the paperwork it states that the Bailiffs that they sent were trying my doors at anything from 6.10am to 8.30pm.
They described what side my door opened and what type of locks were on the door.
This could easily explain a lot of what I'm feeling.
They even knocked on my neighbour before 7am asking who lived here.
