Hello, I am looking for help with regards to a recent CCJ. The court issued by default for the claimant. the total amount is around £6500 for repairs to the claimants vehicle following an accident a few years ago. However the insurance company has settled the claim before the CCJ was issued. I am writing on behalf of my father who is 88 years of age and is worrying about the ccj. I have started filling out a N244 form to appeal. any advice would be greatly appreciated. if you require any more information please let me know.

This is a third party motor insurance claim so in principle should be dealt with by his motor insurers (the insurance company who insured him at the time of the accident and dealt with it at that time). So contact them as soon as possible.
The potential issue of course is that third party claims should be reported immediately and your father's insurer may say that there is no claim to defend because it has gone to court and judgement has been issued.
How did the default judgement happen? Did your father receive no court paperwork?All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.

Hi, thanks for having me. Sorry for the delayed response. My father received court paperwork but disposed of them after being advised by the insurer that the claim had been settled. The disgruntled claimant was unhappy with waiting since October 2023 for the settlement so raised an online court claim for payment for damages to the car, interest and fees £6500. He's 88 and his wife (same age) was in hospital when the paperwork came through, she's bedridden and to top it his brother died so he was quite distracted. Now he has received judgement and can't cope with it (who would at 88?) so I decided to try to get it squashed. They don't have much money so, I'm assisting. I have the form, and I'm trying to get a letter from the insurer to say that it is settled (date and to whom it was paid). I'll hand the N244 over to someone. Not sure where to send it, and pay something for it no doubt, but I don't know how much. Having never had a CCJ on my bucket list, it's all very new to me. Hoped this forum would assist.

Are you able to phone the insurance company instead of waiting for a letter? You should do this in the presence of your father, the company will probably want your father's permission that you can speak on his behalf
N244 application may cost as much as £303. N441 should be free of charge. The claimant has 4 weeks to object, otherwise the court issues the certificate automatically
As the judgement was in default and the claim not allocated to a county court, you should send the form to the business centre in Northampton and serve a copy on the claimant
