    Good morning all , I had my first collision yesterday where another person pulled out on me and damaged the drivers side wing and door and also wheel and wishbone / suspension leg . The car hit me very hard , luckily I have cctv so it shows the other driver at fault . I informed my insurance company and the advise possible write off . I’m absolutely gutted as I’m still paying for the car via a loan and last year had to get another loan for £11,000 due to the dpf filter failing and blowing up the engine . My question is if they write it off , the settlement price will be a lot lower than what I owe on the vehicle , can I claim back the difference ? My car would have been good for the next ten years if the guy had not run into me . It’s so unfair that I am going to potentially lose my car and be out of pocket by thousands of pounds .

    No, in the event of a write off the insurance company is only liable for the pre-accident market value of the vehicle, less any excess

    Search the internet for similar cars of age and mileage that are for sale and take copies. This info may help if you need to negotiate with your insurance company the value of your car upwards

    Inform the finance company about the accident, they are still the legal owner, and read your finance agreement about accident repair. If the car is not a write off and repairable they may want control over the selection of repairer

    Gap cover insurance bridges the gap between what you still owe on the car and the amount the insurance company pays out

      Many thanks for your response . I don’t have finance on the vehicle , I took a private loan . The person who hit me was driving an old banger covered in dents and still drivable whilst mine is potentially written off

        A personal loan is some good news. If it is a write off you may be able to buy the scrap vehicle back from the insurance company and arrange for repair yourself.
        Hopefully it won't be classified A or B damage by the insurance company

          Thank you again for your response . The insurance company appears to be writing the car off based on the photos , I have asked for the car to be properly assessed as they cannot categorise the write off without that surely ?
          I have taken photos of advertised vehicles same model and mileage as mine as you suggested , so hopefully I won’t get done over on the pay out . Thank you once again for your help .

            The insurance company has a duty to classify the damage which requires inspection by a qualified auto engineer who also assesses the damage and pre-accident value of the vehicle
            If the cost of repair is assessed at over 60% of the value then the insurance company will probably write off the vehicle
            This clearly can't be done on just photos
