  • No Win, No Fee Solicitors who Sue Solicitors

    Hi there. I am new to Legal Beagles after being tasked with undertaking some legal research for my boss. Please bear with me as I have no legal training and limited experience of dealing with legal professionals. The issue is that he instructed a solicitor to help with making an application to the Family Court requesting a variation in spousal maintenance payments that he has been paying without fail since 2010. To cut a long story brief, he began the litigation as a litigant in person but quickly recognised that he was out of his depth. He was recommended to use a solicitor who gave him poor advice. Essentially, he was advised to cease the monthly payments pending a hearing. This resulted in his ex-wife making an enforcement application and him having to seek a second opinion, to get him out of a bad situation. A year has passed and, with his new legal team in place and the maintenance arrears and associated legal costs long since cleared, he has brokered a lump sum to capitalise the maintenance payments and this has been accepted. The question I have is whether anyone can recommend a "NO WIN, NO FEE" solicitor to sue his first solicitor to attempt to recover the money she has cost him. His new solicitor was staggered by this advice and says that no legal professional operating within the family law arena should ever advise to reduce to stop court ordered maintenance payments - particularly as he had the means to pay, It is not an exaggeration, as I witnessed first hand, that these proceedings have made my boss unwell and anxious, hence agreeing on a lump sum to avoid a protracted court process. This is not a query about the spousal maintenance matter - it is expressly aimed at establishing if anyone has any useful tips on finding a solicitor equipped to sue a solicitor on the grounds of Professional Negligence.     Sorry to hear about the situation your boss finds himself in.

    We do not recommend solicitors, however we do have a sister site JustBeagle - Welcome that may be able to assist in the search if you look for professional negligence.

    Also has your boss thought to ask his current legal team for any recommendations?

    No win, no fee solicitors are not that easy to find and your boss should be careful about any terms he enters into on that basis.

      I have no personal experience in this topic and am unable to recommend a solicitor

      There is an article about claims against solicitors at www.hughjames.com titled "Negligent solicitors"

      The article mentions Conditional Fee Agreements (no win, no fee agreement) as well as After The Event insurance (which covers most of the defendant's legal costs if the claim is unsuccessful)
